Asset Protection

Asset protection planning is a specialized subsection of estate planning and involves not only looking at how to preserve and protect assets AFTER death, but also the protection of your assets DURING life. This requires your attorney to have a thorough understanding of your current personal and financial situation, the types of investments currently owned, and how such assets are titled. Depending on the type of investments or assets, in some cases, the best asset protection planning means taking no action at all. In many cases, however, proactive planning can be accomplished through Hawaii’s Asset Protection Trust law enacted in 2010 and further strengthened in 2011. An Asset Protection Trust may be appropriate for the following individuals:

  • Clients with high exposure to lawsuits given their occupation
  • Clients who have accumulated some wealth looking to gift assets to benefit children or grandchildren while also being able to receive funds from the Trust for unforeseen circumstances
  • Clients who receive a structured settlement from a personal injury lawsuit
  • An Asset Protection Trust can also be combined with a Dynasty Trust and other planning techniques to effectively lower a client’s taxable estate. The result is a comprehensive plan to protect assets during lifetime while ensuring the preservation and protection of assets following death.
